Functional models of treaty use
The models are coded for the 78 treaty-reference decisions. Interpretative use is the most frequent model in both institutions.
Methodology
Scope and coding
The study began with 222 published positions. Two administrative items were excluded, producing a corpus of 220 acts: 131 of the Constitutional Council and 89 of the Constitutional Court.
Each relevant act was coded by deciding body, international instrument, subject matter, combination of treaty and soft law, functional model of use, and the apparent relation of the reference to the outcome.
“Treaty reference” means an identifiable reference to a treaty in the decision. Soft law includes instruments such as the Universal Declaration of Human Rights, General Comments, and UN General Assembly resolutions.
